2. What Personal Data We Collect and Why We Collect It

We collect data necessary to operate our social media community, process store orders, and maintain security.

2.1 Data Collected for Social & Community Features (BuddyPress/Youzify)

2.4 Cookies

We use cookies for site functionality and convenience.

  • Comment Cookies: If you leave a comment, you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so you do not have to fill in your details again and will last for one year.
  • Login Cookies: If you visit our login page, we set a temporary cookie (discarded when you close your browser). When you log in, we set cookies to save your login information (lasts for two days) and screen display choices (lasts for a year). Selecting “Remember Me” keeps your login for two weeks.
  • WooCommerce/Store Cookies: Used to keep track of cart contents while you’re browsing our site.
  • BuddyPress/Youzify Cookies: Used to show success/failure messages, and to keep track of browsing preferences in directories (deleted after 24 hours).
  • Abandoned Cart Cookie: We use a record of your email and the cart contents for up to 30 days on our server to repopulate your cart if you switch devices.

2.5 Analytics and Tracking

By default, WordPress does not collect any analytics data. We currently rely on:

  • Web Hosting/Server Logs: Anonymous analytics data collected by our web host, typically including access times, browser type, and page views.
  • App Store Integrations: The mobile application may contain tracking code related to Google/Apple platform analytics to understand app performance and usage.

We do not currently use a separate WordPress analytics package. If we implement one, we will update this policy with details on how to opt out and a link to the provider’s policy.

2.6 Embedded Content from Other Websites

Articles and content on this site may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These external websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction if you have an account and are logged in to that website.

3. Who We Share Your Data With

We only share data with third-party providers necessary for providing our services, processing payments, and maintaining security.

  • Payment Processors (PayPal): When processing payments through Our Store, some of your data (purchase total and billing information) will be passed to PayPal. Please see the PayPal Privacy Policy for more details.
  • Gravatar: An anonymized string created from your email address (a hash) may be provided to the Gravatar service to check if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/.
  • Spam Detection (Akismet): Visitor comments are checked through an automated spam detection service (Akismet) which collects the commenter’s IP address, user agent, referrer, and other comment data.
  • Password Resets: If you request a password reset, your IP address will be included in the reset email.
  • Fulfillment Partners: We share necessary customer information (name, shipping address, email) with our partners who help us provide our orders and store services to you (e.g., shipping carriers).

We generally store information about you for as long as we need the information for the purposes for which we collect and use it.

  • Comments: If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
  • Registered Users: For users that register on our website, we store the personal information they provide in their user profile as long as their account is active.
  • Store Order Information: We store order information for 10 years for tax and accounting purposes. This includes your name, email address, and billing and shipping addresses.
  • Abandoned Cart: Records of your email and cart contents are kept for up to 30 days.

5. What Rights You Have Over Your Data

You have the following rights regarding your personal data:

  • Access and Export: If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
  • Rectification: All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Visitor comments are checked through an automated spam detection service (Akismet).

We do not engage in automated decision-making that significantly affects user rights. We may aggregate your activity and purchase data into an advertising profile for the purpose of serving generalized custom advertisements via Youzify or platform networks (Google, Apple). You have the right to opt-out of these advertisements where possible through your device or platform settings.

Please read these Terms and Conditions (“Terms”, “T&C”) carefully before using the

FourElementsPress.com website and its associated mobile application (“App”) operated by Four Elements Press LLC (“us”, “we”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

The Service is a community-based social media platform powered by WordPress, utilizing plugins such as BuddyPress, Youzify, and Better Messages, and distributed as a mobile application via platforms including AppMySite, the Apple App Store, and Google Play Store.

Key features of the Service include:

  • User profiles and customizable settings.
  • Creation and participation in private and public groups.
  • An activity feed for user-generated content and posts.
  • Direct messaging features provided by Better Messages.
  • A proprietary press posts feed and an integrated store (“Our Store”) for digital or physical goods sold directly by us.

2. User Content and Conduct

2. User Conduct, Objectionable Content, and Moderation

2.1 Responsibility for Content

You are solely responsible for all content, including but not limited to photos, text, videos, posts, and comments (“User Content”), that you publish, upload, link to, or otherwise make available via the Service.

2.2 Zero Tolerance and Objectionable Content Policy

By accessing or using the Service, you acknowledge and expressly agree to our Zero Tolerance Policy toward objectionable content and abusive behavior.

Objectionable Content is defined as content, including but not limited to, User Content, private messages, or profile details, that is illegal, defamatory, threatening, discriminatory, sexually explicit (including non-consensual nudity), harassing, hateful, or harmful.

You agree that: a) There is no tolerance for objectionable content on this Service. b) There is no tolerance for users who engage in abusive or harassing behavior toward other members. c) Violating this policy will result in immediate and necessary action, up to and including permanent termination of your account, at our sole discretion.

2.3 User-Generated Content (UGC) License

By publishing User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable license to use, reproduce, modify, publicly display, and distribute your User Content in connection with the Service and our (and our successor’s) business, including for promoting and redistributing part or all of the Service in any media formats and through any media channels. This is our User-Generated Content (UGC) clause.

2.4 Moderation and Technical Precautions

We utilize the following technical and procedural safeguards to maintain a safe environment:

  • Content Filtering: We employ technical filtering mechanisms (including automated keyword detection and image scanning tools via third-party plugins) and proactive human moderation to help detect, review, and remove objectionable content from our platform.
  • Flagging Mechanism: Users can report content they deem objectionable via the ‘Report’ or ‘Flag’ feature readily available on every post, comment, or user profile. All users commit to reporting violations promptly.
  • User Blocking: Our Service provides a ‘Block User’ feature, allowing members to prevent specific users from contacting them, commenting on their content, or viewing their profile.

2.5 Developer Action and Enforcement (24-Hour Commitment)

We are committed to swift and decisive action regarding reported violations:

  • Reporting Review: We commit to reviewing all content reports received and taking definitive action on any content deemed objectionable (including content removal, content restriction, and/or user ejection) within 24 hours of the report being filed.
  • Enforcement: In the event of a breach of this Zero Tolerance Policy, we reserve the right to immediately and permanently terminate the account of the offending user without liability and remove all related objectionable content.

3. Store and Purchases

The Service includes a proprietary e-commerce function (“Our Store”).

3.1 Transactions with Us

All purchases made through Our Store are transactions between you and

Four Elements Press LLC. We are responsible for the fulfillment, quality, and support related to those products.

3.2 Third-Party Sales

The Service is explicitly designed not to facilitate sales between users or third-party vendors. You acknowledge that you cannot sell goods or services to other users through the Service’s e-commerce platform.

3.3 No Refund and Fulfillment Policy

All sales through Our Store are final and subject to a strict No Refund Policy. However, we are committed to ensuring proper fulfillment and delivery. Where an order goes wrong in consideration of fulfillment (e.g., incorrect item sent) or delivery (e.g., package lost or damaged), we will work with the customer on an individual basis to set expectations and make things right, which may include shipping a replacement or providing a credit, at our sole discretion.

4. Advertising Policy

You acknowledge and agree that the Service, including the mobile app and website, may display advertisements and promotions.

  • App Store Ads: The mobile application may contain advertising served through integrations with Google and other platform-specific ad networks (e.g., within the iOS App Store or Google Play Store ecosystem).
  • Custom Ads: The Service may display custom advertisements integrated through the Youzify plugin or other platform mechanisms.

We are not responsible for the content of any third-party advertisements or the goods or services provided by the advertisers. Your dealings with any third-party advertisers found on or through the Service are solely between you and the advertiser.

5. Virtual Points (Elemental Points)

The Service features a virtual point system (“Elemental Points”) facilitated by the myCRED for BuddyPress integration.

5.1 Purchase and License

Elemental Points may be purchased with real-world currency to enhance your experience within the Service. Your purchase of Elemental Points constitutes the purchase of a limited, non-transferable, revocable license to use the Elemental Points solely within the Service. You acknowledge that you do not own the Elemental Points but are licensed to use them subject to these Terms.

5.2 Non-Redeemability and Value Changes

Elemental Points are not redeemable, refundable, or exchangeable for fiat currency, real money, or any item of real-world value.

  • Value Discretion: We reserve the right, at our sole discretion, to change the price required to purchase Elemental Points (the exchange rate), the cost of internal features/items bought with points, or the rate at which points are earned, at any time without liability. Past purchases do not guarantee a fixed exchange rate or value for future transactions.

5.3 Usage and Transfer

Elemental Points are earned by engaging in designated BuddyPress activities and may be used for internal features such as ranking on a public leaderboard. Users may transfer Elemental Points to other users, but such transfer does not imply, create, or transfer any monetary value outside the Service.

5.4 Point Discretion

We reserve the absolute right to manage, regulate, control, modify, or eliminate Elemental Points at any time, with or without notice, and we shall have no liability to you or any third party based on our exercise of such rights.

6. DISCLAIMER OF WARRANTIES (No Liability)

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT:

YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

  1. THE USE OR THE INABILITY TO USE THE SERVICE;

9.2 Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9.3 Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days’ notice before any new terms take effect.
